Arizona Pharmacist License Lawyers Who Fight for Your Rights

pharmacist license lawyerWhen facing a complaint filed against you with the Arizona State Board of Pharmacy, your instinct might be to handle the matter without consulting with an experienced pharmacist license lawyer. You might feel that if you can “just explain” the situation, you’ll be able to resolve it quickly and easily.

That would be an inaccurate & irresponsible decision.

Unfortunately, pharmacists who take on a Board investigation without a professional license attorney put their license and career at unnecessary risk. A simple misunderstanding or misstep during the process can lead to an outcome that you didn’t expect or want. If you’re under investigation, it’s more prudent to have a pharmacist license lawyer familiar with the complexities of the Board investigation process to guide your steps, right from the start.

Arizona Law Group is committed to protecting the interests of pharmacists and pharmacy technicians facing investigations and disciplinary actions from the Arizona State Board of Pharmacy. We can help you determine the best course of action, establish a well-reasoned defense, and obtain the most favorable outcome possible.

Potential Disciplinary Actions Against Pharmacists

The Arizona State Board of Pharmacy’s duty is to protect the citizens of Arizona from the unprofessional conduct or incompetence of pharmacists. It investigates all complaints against pharmacists and pharmacy technicians. For each complaint, the Board determines whether to dismiss it or recommend disciplinary or non-disciplinary actions against the pharmacist.

These disciplinary actions may include:

  • An Advisory Letter
  • A Letter of Reprimand
  • Order for Continuing Education
  • Order for Rehabilitation
  • Assessment of RPh competence
  • A Decree of Censure
  • Civil Penalty
  • Probation
  • Suspension
  • Restrictions on scope of practice
  • Suspension of your license to practice
  • Revocation of your license to practice.

All Board resolutions are a matter of public record. If you fail to comply with a Board order, your license could be suspended or revoked.

Speaking with one of our experienced pharmacist license defense attorneys can prevent these actions.

What to Expect: Pharmacist License Attorneys Representing Your Interests During a Pharmacy Board Investigation

The Board of Pharmacy initiates an investigation when someone files a complaint. The staff reviews the complaint to ensure that it fulfills minimum requirements, then assigns it to a Compliance Officer for further investigation. The Officer will contact both the complainant and the pharmacist for further evidence and statements.

After the investigation is complete, the Officer submits a written report to the Deputy Director of the Board, who searches for additional complaints against the pharmacist or pharmacy. The Board of Pharmacy Review Committee will then analyze the entire file and make recommendations for dismissal, non-disciplinary, or disciplinary action. In serious cases, there will be a full administrative hearing to determine the pharmacist’s incompetence, willful negligence, or endangerment to the public health.

When you learn that you’re under investigation, reach out to an experienced pharmacist license defense attorney immediately. It’s crucial to consult with an attorney before speaking to anyone from the Board. Anything you say to an Investigator may be used against you, even a seemingly informal conversation. Let an experienced licensure defense lawyer, like those at the Arizona Law Group, put a plan of action in place first.

Pharmacist License Lawyers Protect Your Reputation

Arizona law requires all licensed health professionals in Arizona to report almost any misdemeanor arrest or conviction that might affect patient safety or any felony to the Board of Pharmacy within ten working days after the charge is filed. If you fail to do, the Board may take disciplinary action or impose a civil penalty of up to $1,000.

Reportable crimes include, among other things, assault, arson, theft, fraud-related offenses, abuse, neglect or exploitation of a child or vulnerable adult, sexual offenses, drug or alcohol-related offenses (including a DUI), and crimes relating to the abuse of an animal.

Before reporting the misdemeanor or felony to the Board, you should speak to the pharmacy license defense lawyers of the Arizona Law Group to consider your rights and options.

What Is Pharmacists Assisting Pharmacists (PAPA) in Arizona?

Pharmacists Assisting Pharmacists in Arizona (PAPA) is a program that assists pharmacists, pharmacy students,or pharmacy technicians with alcohol or chemical dependency, and other impairments.

If the Board has determined that you have a substance abuse problem or another issue that affects your ability to dispense medicines safely, the Board may mandate your participation in PAPA. The program requires participants to enter into a 5-year contract agreeing to:

  • weekly peer counseling meetings
  • random urine screens
  • monitored 12-step meetings
  • semi-annual reviews.

The program is intended to help pharmacy professionals in recovery after treatment continue their career while dispensing medicine safely. Your participation in the program will be confidential if you self-report your problem to the Board. However, if the Board mandates your participation in the program, your participation will be a matter of public record.

If you are under investigation for substance abuse, or the Board has recommended that you participate in PAPA, or you’re considering self-reporting your problem, speak with a knowledgeable license defense attorney as soon as possible to review your options.
