Types of Disciplinary Actions Against Dentists
As you may know, the Arizona State Board of Dental Examiners oversees complaints against dentists licensed to practice in Arizona and investigates all allegations of violations of the Arizona Dental Act. If the Board finds a violation, it may recommend taking either disciplinary and non-disciplinary actions, including:
- Issuing a Letter of Concern
- Issuing a Letter of Reprimand
- Decree of Censure, possibly with restitution to the aggrieved party.
- Civil Penalty
- Public Warning
- Community Service
- Probation
- Modification of prescription-writing privileges
- Restrictions on scope of practice
- Suspension of the license (possibly with a public warning)
- Revocation of the license.
Failure to comply with a Board order could result in a suspension or revocation of your license.
What Happens in an Arizona State Board of Dental Examiners Investigation?
The Dental Board initiates an investigation when someone, usually a patient, has filed a complaint. If an initial investigation team determines that the allegations could be valid, a Chief Investigator will conduct a full investigation, then return to the Board with one of four potential recommendations:
- a dismissal of the case for lack of evidence
- a non-disciplinary action
- referral to the Executive Director for termination
- disciplinary action by the Board
If the Investigator recommends disciplinary action, you typically will be asked to participate in an Investigative Interview. During this proceeding, the investigator will hear your testimony, as well as the testimony of the complainant and any witnesses. Afterward, the Investigator will assess the evidence and make a recommendation to the Board.
When the Board notifies you of a complaint against you, it is essential to contact an experienced dental license defense attorney as soon as possible. The Arizona Law Group’s dental license defense attorneys understand the defenses and approaches that tend to be most effective in these proceedings. We can help you gather evidence and formulate a clear, accurate response that positions you for the best possible outcome.
Protecting Your Dental License Following a Criminal Arrest or Conviction
Arizona law requires all licensed dental professionals in Arizona to report almost any misdemeanor arrest or conviction that might affect patient safety or any felony to the Board of Dental Examiners within ten working days after the charge is filed. If you don’t, the Board may take disciplinary action or impose a civil penalty of up to $1,000.
Reportable crimes include, among other things, assault, arson, theft, fraud-related offenses, abuse, neglect or exploitation of a child or vulnerable adult, sexual offenses, drug or alcohol-related offenses (including a DUI), and crimes relating to the abuse of an animal.
Before reporting a misdemeanor or felony to the Board, speak to an experienced dental license defense lawyer to fully understand your rights and options.
ASBDE’s Monitored Aftercare Treatment Program
The stress of running a dental practice can lead some dentists to turn to alcohol or drugs for solace. A patient, dental hygienist, or a colleague may report the dentist to the Board for substance abuse, or the dentist may choose or be encouraged to self-report a problem. In either case, the Board will conduct an investigation.
If the Board finds that you have a substance abuse problem, you will likely have to participate in the Monitored Aftercare Treatment Program to continue to practicing. This confidential program is designed to help you recover from your substance abuse problem while ensuring, through regular monitoring, that you are safe to practice dentistry. If you refuse to enter this program or fail to adhere to the terms of the program agreement, your dental license may be suspended or revoked.
If you are under investigation for substance abuse or the Board has asked you to participate in a treatment program, you should speak with a knowledgeable license defense attorney as soon as possible to review options that best protect your license and reputation.
